Stanchions Express Terms and Conditions:
Stanchions Express products are warranted to be free from defects in material and workmanship for a period of 1 year from the date of shipment. Stanchions Express, at its sole option, will repair or replace any defective merchandise during the warranty period. There are no other warranties, expressed or implied; including, but not limited to, the implied warranty of merchantability and fitness for any particular purpose. All such warranties are expressly and specifically disclaimed. Unless specifically agreed to in writing, Stanchions Express will not be held responsible for missed delivery dates or the performance of third parties; including but not limited to, shipping companies. In no event will Stanchions Express be responsible for any direct, special, incidental or consequential damages or lost profits.
Damage Claims and Shortages:
All shipments are sent FOB shipping point with freight added on to your order based on the total weight, address, zip code and whether it is a residential or commercial address. All claims for damage or loss during shipping are the responsibility of the purchaser and all claims should be made directly to the delivering carrier. If your products are damaged in shipping and you are aware of this damage on receipt of the products, you must sign for the products as damaged or run the risk of having your claim denied by the carrier. Stanchions Express will not be held responsible for any damage claims not signed for as damaged on receipt. All claims for damage or loss during shipping are the responsibility of the purchaser and all claims should be made directly to the delivering carrier. However, in most cases, Stanchions Express will assist you in filing a claim for lost or damaged products in the event of damage or loss, but at the discretion of Stanchions Express. If, however, Stanchions Express assists the consignee in filing a claim, it does not accept the responsibility for any damage and or loss during shipping. Refusal of a shipment will be considered abandonment by the purchaser and will not relieve the purchaser of any of the obligations contained within this agreement. All charges paid by Stanchions Express for return freight and or storage will be billed to the purchasers account and be immediately due together with a 30% handling and restocking charge. If you choose to use your own shipping company or carrier, billed third party to your account, you accept all responsibility of loss or damage and are fully responsible for filing any claims. The purchaser assumes the responsibility to thoroughly inspect each shipment before accepting it. If the purchaser or its designee accepts a shipment as complete and without exception, they will lose the ability to file a claim with the shipping company and or Stanchions Express, so you need to make sure that you or your designee inspects each and every shipment for loss or damage.
All claims must be made in writing, within seven (7) days of the receipt of goods. No returns will be accepted without prior written authorization and a return goods authorization issued. All returns must be in new, salable condition and must be returned with the freight charges prepaid by the purchaser. No credit will be allowed unless the seller has had the option to examine the goods at the seller's place of business or the seller has waived this requirement in writing and a Stanchions Express credit memo has been issued. Returned goods are subject to a restocking charge of 30% that will be used to offset the cost of inspecting and repackaging the returned goods. Any custom sized or custom logo products that you custom ordered cannot be returned for credit unless damaged in transit or it was not manufactured to the exact specifications. For any custom orders, you will be asked to approve and sign-off before any order is entered for production. All custom orders must be paid-in-full prior to production and cannot be canceled once production has started.
All payments for purchases must be paid in full prior to placing an order. Stanchions Express accepts Visa, Master Card, Discover and American Express. All orders must be paid-in-full prior to shipping.
Past due invoices and charges will be charged interest at the rate of 1 ½% per month. Invoices open for 45 days or longer will be considered delinquent and will be placed for collection. In the event of an account being placed for collection, the purchaser agrees to pay, in addition to the principal amount due, accrued interest, plus all reasonable collection costs incurred by the seller, including but not limited to, charges due to a collection agency up to 30% of the total outstanding balance. In the event of a law suit, the purchaser agrees to pay the seller's reasonable attorney fees and any additional expenses including, but not limited to, court costs. A charge of $35.00 will be added to the purchaser's account for any returned check.
All items purchased remain the property of Stanchions Express by Quik Stage until payment in full have been received by Stanchions Express by Quik Stage and all payments have cleared in full at our bank or credit card processing facility. In the event payments do not clear as described above and you are in receipt of our products, all products must be returned in its original condition at the purchasers expense and are further subject to all terms and conditions listed in our terms and conditions.
This agreement is governed under the laws of the State of Minnesota and legal action taken under this agreement shall be in the Circuit Court for Anoka County, Minnesota or the United States District Court for the Northern District of Minnesota.
Stanchions Express is a division of Quik Stage, Inc. but operates separately in terms, conditions and warranties. Any terms, conditions and warranties offered by Quik Stage for any other products not listed on the Stanchions Express web site have no relevance to any items offered by Stanchions Express.
This agreement may only be executed by a person with the authority to do so. By placing an order with Stanchions Express, either online, by phone or any other means, you are acknowledging that you have read, understood and agree to the terms contained within this agreement.
